BNSF now in charge of rail yard tracks where asbestos was allegedly spread

BNSF has reached an agreement with federal and state officials regarding rail yard tracks in northwest Montana.
The Class 1 company is being accused of contaminating the tracks with asbestos. The Environmental Protection Agency, Montana Department of Environmental Quality and BNSF decided that BNSF will be responsible for operating and maintaining 42 miles of track.
Officials claim BNSF transported vermiculite along the tracks, which spread asbestos across the area. BNSF says it is committed to implementing best practices and ensuring the protection of the community.
Earlier this year, the Montana Supreme Court ruled that BNSF could not shield itself from liability for transporting vermiculite contaminated with asbestos.
The public has until Sept. 30 to respond to the agreement.
