Maryland’s Purple Line project takes another hit

Maryland’s Purple Line might as well be called the Black-and-Blue Line. The hits keep on coming. Earlier in May the contractor building the project said he was going to quit due to extensive delays on the project. Well, here comes another delay, as opponents of the light-rail construction project are appealing a recent court decision.
The plaintiffs, Friends of the Capital Crescent Trail, Chevy Chase resident Leonard Scensny and former Chevy Chase resident John Fitzgerald, say the judge that dismissed the most recent case did it before hearing oral arguments. The appeal was filed with the U.S. Court of Appeals for the 4th Circuit in Richmond, Va. Briefs are scheduled for the summer.
A federal judge dismissed the lawsuit on April 13, saying the plaintiffs failed to show work by the U.S. Army Corps of Engineers was illegal under the Clean Water Act.
Three lawsuits have been filed against the Purple Line construction. The first delayed work by more than a year before it was rejected by a federal appeals court in 2017. A second lawsuit was dismissed in 2019.
